Our website provides our most comprehensive and up-to-date information for tenants and occupants under Renting Advice.

However, we also provide Tenancy Kits and Occupancy Kits so that tenants and occupants have information on the most common issues on hand when they need it, without needing internet access.  These kits contain a selection of the most important Factsheets. 

Which Kit – tenancy or occupancy?

The law is very different for tenancies and occupancies, so it is important to have the right kit.  As a general rule:

  • Occupancy Kits should be provided to people living in university accommodation, caravan parks, hotels/motels/boarding houses, and boarders/lodgers or people who live with the owner of the house.  The Occupancy Kit contains the Factsheet Occupancy Agreements which provides more information on who is an occupant and who is a tenant.
  • Tenancy Kits should be provided to everybody else, and to anybody who has a written agreement which says that it is a “Residential Tenancy Agreement”.  

Keep your kit somewhere safe with your condition report, receipts and letters.  Look it up when there’s an issue, eg you need to get repairs done, the owner wants to increase the rent or do an inspection, or you want to move out and get your bond back.
